By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. General Rules

• Provision of Services: We commit to delivering services professionally and in accordance with applicable laws.
• Eligibility: You must be 18 or older, provide accurate billing details, and agree to the Terms, DPA, and Anti-Spam Policy.
• Acceptance: Usage implies acceptance. Non-compliance may result in suspension or termination.

2. Payment Terms

• Billing Cycle: Payments are due at the beginning of each billing period. Overages will incur additional fees.
• Pricing: See our Pricing Page. Prices may change at any time.
• Taxes: VAT and/or sales tax applies unless exempt. Tax will be shown at checkout.

3. Delivery and Filtering

• Delivery: We aim to deliver emails/SMS but cannot guarantee final delivery.
• Filtering: Services include filtering for spam; however, virus scanning is not included.
• Limitation: We are not liable for filtering errors or delivery failures.

4. Communications

Communications refer to all messages sent through our services. You agree to receive account-related messages from us.

5. Accounts and Security

• You are responsible for your login credentials and activity on your account.
• Inactive accounts (6+ months) may be deleted. You will receive notice beforehand.

6. Use of Services

• Compliance with CTIA, GDPR, and CCPA is required.
• Recipients must have opted in or have legal basis for communications.
• No sending to purchased/rented lists is allowed.
• Unsubscribe links are required in marketing emails/SMS.

7. Content and Ownership

• You may not send prohibited content (e.g., scams, hate, gambling, etc.).
• You confirm that you have rights to all submitted content.
• We may review and suspend content violating these terms.

8. Data Protection and Privacy

• We comply with data laws and keep your information secure.
• We don’t share your data unless required for delivery or legal reasons.

9. Intellectual Property

• We retain all IP rights over our services and platform.
• You receive a non-exclusive, revocable license to use the services.

10. Limitation of Liability

• Services are provided "as-is" without warranty.
• We are not liable for indirect or consequential damages.
• Liability is limited to 3 months of fees paid before the claim event.

11. Termination

• You can cancel anytime; prepaid fees are non-refundable.
• We may terminate accounts for violations or non-payment.
• Upon termination, your access and data will be deleted per our policies.

12. Changes to Terms

These Terms may be updated anytime. We’ll notify you via website or email. Continued use implies acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Disputes will be resolved via arbitration or UK courts.
